Train Healthcare – Terms and conditions
1. Who we are
Train Healthcare is the trading name of Train Healthcare Limited, registered in Ireland under company number 719679, with registered office 10 Auburn Terrace, Mullingar, Co Westmeath, Ireland. Our contact address is 10 Auburn Road, Mullingar, Co Westmeath, N91 FH79, Ireland, email contact@trainhealthcare.com, telephone +353 (1) 265 4906 (Ireland) or +44 (0)20 8326 6704 (UK) and Irish VAT registration number 3989288AH. “We” means that entity; “you” means the person or organisation making the booking.
These terms cover our online and face-to-face/classroom training. A consumer buys wholly or mainly outside their trade, business, craft or profession. A business customer buys for business purposes, including employers buying staff training. A company-account label does not remove rights if a purchase is in fact a consumer purchase.
2. Booking and course information
Before payment, we show the course, format, total price including applicable taxes/charges, access period, technical requirements, prerequisites and relevant attendance, assessment and certificate conditions. Check the learner, course, date and format carefully. We do not offer discretionary online refunds for choosing the wrong course, changing your mind or not using it, subject to your legal rights below.
Your booking is an offer to buy. The contract forms when we accept it by sending an order confirmation. A receipt acknowledgement alone is not acceptance unless it expressly says so. The confirmation includes the agreed course details, terms and applicable cancellation information on a durable medium, such as email.
3. Payment
Individuals pay when booking. Approved corporate invoice accounts are invoiced weekly and pay within 30 days of invoice date unless different written terms are agreed before booking. We may suspend further supply for overdue payments after notice and a reasonable opportunity to resolve a genuine dispute. This does not remove rights relating to training already paid for. Pay only through our authorised checkout or verified invoice instructions. Verify payment-detail changes through a known contact route.
4. Access and permitted use
Online access lasts for the period stated before booking, beginning at the start point stated there. Support contact details, availability and technical requirements are provided before booking. Each learner uses their own authorised account. Do not share logins, copy or redistribute materials, resell access or use the platform unlawfully. Materials remain ours or our licensors’; the licence is for the booked learner’s training only.
5. No discretionary online refunds
Business customers: online bookings are non-refundable, including mistaken bookings, unused courses and changes of mind. This does not excuse our failure to supply the agreed training or exclude rights/remedies that cannot lawfully be excluded.
Consumers: we do not offer discretionary online refunds, including for mistaken bookings. This policy is subject to your statutory cancellation rights and remedies if training is faulty, not supplied or not as described. Nothing in these terms removes those rights.
6. Consumer digital-content purchases
For digital course content supplied without a physical medium, you normally have 14 days to cancel without giving a reason, with the cancellation period ending 14 days after the date the contract is made. If you expressly consent to supply starting during that period and acknowledge that you lose your cancellation right when supply begins, the right ends when supply actually begins. We confirm your consent and acknowledgement on a durable medium.
Accepting general terms, a pre-ticked box or creating an account does not by itself waive the right. Without the required consent and acknowledgement we will not start supply during the cancellation period. Where you cancel while the right exists, we refund the amount due within 14 days after you tell us, using the same payment method unless you expressly agree otherwise, without a refund fee.
If digital supply starts during the cancellation period without the required consent, acknowledgement or durable confirmation, you will not pay for that supply where the law says no payment is due. Missing required cancellation information may extend the cancellation period by up to 12 months beyond its normal end; this is separate from a missing waiver checkbox.
Early-start consent
I expressly consent to Train Healthcare starting supply of my digital course content immediately, before the end of my 14-day cancellation period. I acknowledge that I will lose my statutory right to cancel once supply of that digital content begins.
7. Live, tutor-led and mixed online training
If online training is a service or digital service rather than digital content, different rules apply. A consumer normally has 14 days to cancel, with the cancellation period ending 14 days after the date the contract is made. If you expressly request an early start on a durable medium, such as email or the recorded checkout request, you may cancel before full performance, but may owe a proportionate amount for the service supplied if the required information and request were given. The right ends only on full performance if you requested the early start and acknowledged that result beforehand.
Portal access does not automatically remove a live-service cancellation right. For mixed contracts we explain rights for each element before booking. We do not use the digital-content checkbox to waive service rights.
Early-start request
I expressly request that my training service starts before the end of my 14-day cancellation period. I understand that if I cancel after it starts, I may have to pay a proportionate amount for the service supplied. I acknowledge that I will lose the cancellation right once the service is fully performed.
8. Classroom cancellation, lateness and non-attendance
Arrive before the advertised start time. Late entry is at the trainer’s reasonable discretion, taking account of missed content, safety, assessment requirements and disruption. If you miss essential content you may be refused entry or a certificate. For example, arriving at 11am for a 9am start may mean you cannot join the class.
We do not offer discretionary refunds for non-attendance or late arrival due to traffic, travel disruption, illness including Covid, or other circumstances not caused by Train Healthcare. Do not attend if doing so would breach applicable health advice or create a material risk to others; tell us promptly. This does not guarantee a refund or transfer.
Business customers: classroom places are non-refundable for these learner-side no-shows or late arrivals, subject to rights that cannot lawfully be excluded. Other business cancellations/rescheduling are subject to the cancellation and rescheduling terms supplied before booking. Consumers: statutory cancellation rights remain; after those rights end, cancellation/no-show charges will not exceed our reasonable net loss, taking account of costs saved and reasonable opportunities to refill a place. If the full fee exceeds that loss, we refund the difference. We explain the calculation on request.
Consumers booking at a distance normally have the 14-day service cancellation right in section 7 unless a genuine legal exception applies. A dated professional training class is not automatically exempt. If it starts within that period we obtain the required early-start request and acknowledgement. Any rebooking or transfer is subject to our agreement; free rebooking is not guaranteed. Learner name substitutions may be requested up to the day before classroom training, subject to course prerequisites.
9. Safety, fitness and certificates
Follow trainer and venue instructions, use equipment as directed and behave respectfully. Meet the stated prerequisites and bring the identification and materials specified before booking. Tell us privately about accessibility needs or conditions affecting safe participation. We consider reasonable adjustments. Do not participate in an activity you believe unsafe; tell the trainer immediately. Report incidents/injuries promptly. We may stop unsafe activity or remove participants where reasonably necessary for safety or serious misconduct, assessing charges/remedies fairly and lawfully.
Certificates depend on the published attendance, completion and assessment requirements. Validity, resits, fees and appeal arrangements are set out in the course-specific information supplied before booking. Training does not guarantee employment, professional registration or competence beyond its scope. Employers remain responsible for workplace induction and supervision. Acknowledging risks does not waive our duty of care.
10. If we change or cancel training
Minor updates must not materially reduce agreed training. If we cancel or propose a material change, we tell you promptly and offer an agreed alternative or a refund for affected training we cannot supply as agreed. We do not force credit instead of a refund where money is due. Other legal rights remain.
11. Faults and remedies
Report problems to contact@trainhealthcare.com with the order reference. Consumer training, digital content and digital services must meet applicable legal standards and the agreed description, purpose and other contract requirements. We provide services with the necessary skill and reasonable care. If we fail to meet these requirements, remedies may include bringing the training, content or service into conformity at no cost, an appropriate price reduction or ending the contract and receiving a refund where the legal conditions are met. Any refund required under Irish consumer law is made within the applicable legal deadline, normally 14 days after we are informed of a qualifying cancellation or price-reduction claim. Any additional mandatory rights applicable to UK or other consumers remain. No-refund terms do not override these rights.
12. Accidents, incidents, injuries and liability
We are not responsible for accidents, incidents or injuries that are not caused by our negligence, breach of contract or other legal responsibility. Participants must follow safety instructions and take reasonable care for themselves and others. This does not transfer our duties to participants or remove responsibility for trainers, staff or others for whom the law makes us responsible.
Participants take part voluntarily and accept the normal risks of physical training, to the extent the law allows.
Nothing excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or other liability that cannot lawfully be excluded or limited. An “attend at your own risk” statement does not remove those protections.
For consumers we are responsible for foreseeable loss or damage caused by our breach or failure to use reasonable care and skill. Consumer statutory rights remain.
13. Data protection
We handle personal information as explained in our customer privacy notice. Employer bookings may involve lawful sharing of attendance, progress, results and certificates as explained there. Do not include identifiable patient or resident information in training examples.
14. Complaints and applicable law
Booking or course complaints: contact contact@trainhealthcare.com or 10 Auburn Road, Mullingar, Co Westmeath, N91 FH79, Ireland with your order reference and details. We acknowledge complaints and respond without undue delay, explaining delays. If a consumer complaint is unresolved, we give legally required information about an appropriate alternative dispute resolution provider and whether we are obliged or willing to use it.
These terms use the law of Ireland. This does not remove a consumer’s mandatory protections under the law of their country of habitual residence, including applicable UK consumer rights, or any mandatory right to bring proceedings in their home jurisdiction. Business disputes fall within the courts of Ireland. New terms apply to future bookings; existing contracts change only by lawful agreement.
